Femi Falana, a Senior Advocate of Nigeria (SAN), emphasized that any convening of the Rivers State House of Assembly outside its designated complex holds no legal standing. Speaking on Channels Television’s Sunday Politics, Falana addressed the ongoing political turmoil in Rivers State,Daily Trust reports.
Governor Similanayi Fubara recently issued an executive order directing the immediate relocation of the Assembly’s sessions to the Auditorium, Admin Block of the Government House, Port Harcourt, citing safety concerns regarding the Assembly complex.
However, Falana contended that Fubara’s directive contradicts the fundamental principle of separation of powers, asserting the independence of the legislature from the executive branch. He recalled a precedent in Oyo State where the Supreme Court invalidated proceedings held in a hotel, underscoring the constitutional requirement for legislative sessions to be conducted within the Assembly premises.

Falana stressed that any Assembly session convened outside its designated complex lacks legal recognition. He emphasized that if relocation is deemed necessary, it must be decided upon by the duly constituted members of the Assembly.
